Feb. 17, 2009).  In Whittier, Ms. Sandoval’s client, the school district, appealed from the judgment entered in favor of the defendant after the jury returned a special verdict finding that the defendant was not negligent.  On appeal, Ms. Sandoval argued that the trial court erred in refusing to instruct the jury on the elements of negligence per se.  The appellate court agreed and reversed.  Without retrying the case, Ms. Sandoval was able to obtain a favorable outcome for the client.
